Bowmanville Men’s Basketball League Constitution

ARTICLE 1: NAME
The name of the League is the Bowmanville Men’s Basketball League, hereafter referred to as the BMBL, a non-profit organization, founded in 1955, located in the Municipality of Clarington.

ARTICLE 2: OBJECTIVES
a. Foster, develop and promote the game of basketball in a spirit of good sportsmanship, fun and fair play.
b. Achieve and maintain parity among all teams.

ARTICLE 3: LEAGUE OFFICERS
a. A League Officer must be a member in good standing of the BMBL.
b. The League Officers are the President, Vice President and Treasurer.
c. The League Officers, as a committee, have authority to manage and control the affairs of the BMBL subject to restrictions in the Constitution.
d. The League Officers, as a committee, have authority to contravene the Constitution in matters where the Constitution cannot be held as an authoritative document.
e. The League Officers, as a committee, establish the yearly membership fees to be paid by members and new applicants.
f. The League Officers, as a committee and in conjunction with the Captains, determine if disciplinary action toward a constituent is required and what action is to be taken.
g. The League Officers, as a committee, may appoint Special Officers. The League Officers determine the duties and responsibilities of the Special Officers.
h. The League Officers, as a committee, may appoint Special Committees. The League Officers determine the duties and responsibilities of the Special Committees.
i. The League Officers are elected each year at the Annual General Meeting. Election is by secret ballot. Election is by a simple majority of votes.
j. Any member in good standing may stand for election to become a League Officer.
k. All nominations for League Officers must be submitted to a League Officer two weeks prior to the Annual General Meeting.
l. If only one candidate stands for election to a League Office, that candidate is acclaimed and an election will not be held.
m.The term of office for outgoing League Officers terminates at the end of the Annual General Meeting.
n. Any League Officer absent without just cause for three consecutive meetings, as determined by the other League Officers, will be subject to dismissal.
o. If a League Officer must be replaced during their term of office, the League Officers will appoint another member in good standing to the vacated office.

ARTICLE 4: POWERS AND DUTIES OF THE PRESIDENT
a. Serve as the senior Officer of the BMBL.
b. Preside at all meetings of the BMBL.
c. Act as a spokesperson for the BMBL at all times, unless he/she delegates such responsibilities.
d. Obtain appropriately skilled officials for all games played in the BMBL.
e. Address difficulties and issues that may arise with officiating in the BMBL.

ARTICLE 5: POWERS AND DUTIES OF THE VICE PRESIDENT
a. Serve as the second most senior Officer of the BMBL.
b. Preside at all meetings of the BMBL in absence of the President.
c. Prepare schedules for all BMBL regular season and playoff games.
d. Keep official BMBL regular season and playoff statistics.

ARTICLE 6: POWERS AND DUTIES OF THE TREASURER
a. Keep full and accurate account of receipts and disbursements in books belonging to the BMBL.
b. Deposit all money and other valuables in the name of the BMBL and to the credit of the BMBL in such depositories as may be designed by the League Officers.
c. Pay all accounts due by the BMBL.
d. Prepare financial statements submitted at the Annual General Meeting.
e. Be the custodian of the deposits and receipts of the BMBL and produce such books, properly balanced, at all times, at all meetings of the BMBL.
f. Act as the recording secretary at the Annual General Meeting.


ARTICLE 7: ANNUAL GENERAL MEETING
a. The Annual General Meeting serves as the vehicle to conduct business concerning the BMBL.
b. Operational status for the past year and current financial status are reviewed.
c. Auditors may be appointed annually at the AGM to audit the books of the BMBL for the ensuing year.
d. Old business is reviewed.
e. New business is introduced, debated and voted upon.
f.  Election of vacant Captain positions takes place.
g. Election of League Officers for the following year takes place.
h. Members in good standing may voice and vote at the meeting.
i. All votes are by secret ballot.
j. Proxy voting will not be permitted.
k. The President of the BMBL only votes to break a tie vote.

ARTICLE 8: FEES
a. Fees are established by the League Officers prior to the Week 1 of Scrimmage. Fees are based on calculation of operational costs.
b. Fees for tentative new applicants must be paid in full no later than 8:00PM Week 2 of Scrimmage.
c. Fees for members must be paid in full no later than 8:00PM Week 3 of Scrimmage.
d. Tentative new applicants not placed on a BMBL team will have their fees refunded in full.
e. The treasurer will not accept post-dated checks.

ARTICLE 9: CONSTITUENTS
a. The membership and new applicants comprise the constituents of the BMBL.
b. Membership conveys a guaranteed assignment to a BMBL team for the playing season.
c. Members may request and are automatically granted a one year sabbatical once every five years without loss of membership the following year. The request must be made by 8:00PM Week 2 of Scrimmage.
d. Membership is open to all individuals nineteen years of age or older as of September 1 of the current year.
e. Membership can be granted only to individuals in good standing with the BMBL. In good standing means no disciplinary actions are outstanding against the individual and all fees due have been paid by the individual.
f. Membership can be granted only to individuals that have played in the BMBL for two or more consecutive full seasons, including the most recent season, unless they were on sabbatical.
e. Membership can be granted only to individuals who have signed a BMBL waiver form before Week 1 of Scrimmage.
f. Membership can be granted only to individuals who have read the Constitution and agree to abide by its Articles.
g. Individuals wanting to play in the BMBL that are not members are considered "tentative new applicants".
h. Tentative new applicants must in good standing with the BMBL.
i. Tentative new applicants must sign a BMBL waiver form before Week 1 of Scrimmage.
j. Tentative new applicants must read the Constitution and agree to abide by its Articles.
k. A tentative new applicant selected to a BMBL team is considered a "new applicant".
l. New applicants are subject to probationary period of not less than two years. Consideration of membership for new applicants will be given after the probationary period has expired.
m. Constituents must commit to and attend a minimum of seven of the first fifteen regular season BMBL games. Failure to do so, without just cause as determined by the League Officers, will result in the removal of the constituent from the BMBL team and termination of the constituent's membership or new applicant status.
n. The League Officers can terminate an individual's membership or new applicant status for cause. Such cause includes but is not limited to: contravention of any of the Articles of the Constitution, conduct bringing the League into disrepute or actions detrimental to the BMBL. Any individual considered to be guilty of an offense or misconduct covered by this Article shall be afforded the opportunity to appear before the League Officers to show cause why membership should not be terminated. The League Officers may, at their discretion, declare the fees or any portion thereof, posted by an individual to be forfeited.

ARTICLE 10: CAPTAINS
a. Captains must be members in good standing.
b. Captains promote, foster, good sportsmanship, team parity and fair play.
c. Captains must attend all Scrimmage Weeks to evaluate tentative new applicants.
d. Captains must attend draft night to select their BMBL team.
e. Captains must attend trade night to equalize the teams of the BMBL.
f. Captains must attend all required meetings dealing with BMBL operations.
g. Captains must collect their team jerseys at the end of playing season.
h. A Captain not performing their duties in an acceptable manner, as determined by the League Officers after the end of the playing year but before the Annual General Meeting will be subject to dismissal.
i. Vacancies for Captain positions are filled by election at the Annual General Meeting. Election is by secret ballot. All candidates are placed on a single ballot. Each voter may vote for as many candidates as there is vacancies. The candidates with the greatest number of votes are elected to fill the vacancies.
j. Any member in good standing may stand for election to become a Captain.
k. All nominations for Captain must be submitted to a League Officer two weeks prior to the Annual General Meeting.
l. If only as many candidates are nominated as there are vacancies for Captain, all candidates are acclaimed and an election will not be held.
m. If a Captain must be replaced during their term of office, the League Officers will appoint another member in good standing to the vacated office.
n. The Captains, as a committee and in conjunction with the League Officers, determine if disciplinary action toward a constituent is required and what action is to be taken.

ARTICLE 11: TEAM ROSTERS
a. Teams are created each playing season by a selection process to be determined by the League Officers and the Captains.
b. Members and tentative new applicants are eligible for the selection process.
c. All members must be selected to a team.
d. At the start of the selection process, the number of roster spots available for tentative new applicants is determined. No more tentative new applicants than this number may be selected.
e. If a constituent cannot complete the season, they may be replaced by a tentative new applicant of equal skill at the discretion of the League Officers and the Captains. The tentative new applicant must be agreed upon by a majority of the League Officers and Captains.
f. A constituent replaced due to injury retains their current status as a member or new applicant. The League Officers and Captains determine a constituent's status if replacement is for any other reason.
g. Trades occur after the tenth week of the regular season. The objective of the trades is to equalize the talent between all BMBL teams.

ARTICLE 12: SUSPENSIONS AND DISCIPLINARY ACTIONS
a. If a player accumulates two technical fouls during a game, the player is ejected from the game and must serve a one game suspension during the next game in which they are eligible to play.
b. If a player accumulates five technical fouls during the playing season, they must serve a one game suspension during the next game in which they are eligible to play. For each subsequent technical foul during the playing season, the player must serve a one game suspension during the next game in which they are eligible to play.
c. Suspensions carry over from the regular season to the playoff season.
d. Suspensions do not carry over from playing season to playing season.
e. If a player is ejected from a game for any other reason during a game the player must serve a one game suspension for the next game.
f. Any act of violent physical behavior or assault toward another person will not be tolerated and will result in minimum suspension from the league for one year.
g. Disciplinary suspensions carry over from playing season to playing season.
h. Any player shooting an 'air-ball' from the free throw line will attend the bar and purchase a pitcher of beer for those in attendance to share. The pitcher cannot be Coke, Water, Chocolate Milk, or Non-Alcoholic Beer. The player in question does have the choice of which beer to purchase.
i. Any player attempting to play a game without their league issued jersey will be subject to a technical foul charged against them. This will result in the opposing team starting the game with two free throws and the ball. If the player in question joins after the game has started then the technical foul will be charged when they enter. The player in question will be allowed to play in a jersey deemed suitable by the opposing team and referees.
j. Lost Jerseys. Any player losing their jersey, or causing excessive damage to it will be fined $50 to cover the cost of a replacement jersey. Once the fine is paid to the treasurer the player will be exempt from Article 12 Section I until the replacement jersey arrives.
